Alcohol and Minors in Texas; Zero Tolerance for Children of the Lone Star State
The following information, as taken from chapter 106 of the Texas Alcoholic Beverages Code, is provided as a general introduction to alcohol related offenses for minors in the State of Texas. Under Texas law a minor, for purposes of alcohol-related offenses, is any person under the age of twenty-one (21), which is the minimum drinking age. To understand how any of the following statutory provisions might apply to the specific facts of your case you should consult with a licensed attorney who can answer your questions. The Court of Criminal Appeals is the highest state court for appeals resulting from criminal cases. The Court holds sessions throughout the year in Austin, Texas. The Court is comprised of 9 members, a Presiding Judge and eight Judges. Decisions of the Courts of Appeals in criminal cases may be appealed to the Court of Criminal Appeals by petition for discretionary review, filed either by the state, or the defendant, or both. In addition, the Court may review a decision on its own motion. All cases which result in the Death Penalty are automatically directed to the Court of Criminal Appeals from the trial court level. Statutory Text On and After 1/1/96:

Sec. 8.07. AGE AFFECTING CRIMINAL RESPONSIBILITY. (a) A person may not be prosecuted for or convicted of any offense that he committed when younger than 15 years of age except:
~ ~ (1) perjury and aggravated perjury when it appears by proof that he had sufficient discretion to understand the nature and obligation of an oath;
[amended 9/1/97] a violation of a penal statute cognizable under Chapter 729, Transportation Code, except for:
~ ~ ~ (A) an offense under Section 550.021, Transportation Code;
~ ~ ~ (B) an offense punishable as a Class B misdemeanor under Section 550.022, Transportation Code; or
~ ~ ~ (C) an offense punishable as a Class B misdemeanor under Section 550.024, Transportation Code;
~ ~ (3) a violation of a motor vehicle traffic ordinance of an incorporated city or town in this state;
~ ~ (4) a misdemeanor punishable by fine only other than public intoxication;
