An alternative to extradition:
Criminal prosecutions under Article 4 of the Mexican Penal Code by Attorney General John Cornyn
Even before the advent of the North American Free trade Agreement (NAFTA) the United States and the Republic of Mexico had been experiencing a relatively steady increase in commerce, travel and immigration across their common border. This heightened interaction contributes to the growth of both nations and will no doubt reshape our futures in many positive ways. Unfortunately, the increased activity also brings with it a huge negative: the growth in crime throughout the border region. Of particular concern are criminals who flee across the border to escape punishment for their offenses. Texas prosecutors who attempt an extradition from Mexico quickly discover the procedure's legal and diplomatic complexities make it very difficult. This is especially true when the person is a Mexican national. As a consequence, frustrated prosecutors often are forced to abandon their pursuit of these dangerous individuals once they cross the border and serious crimes may go unsolved for many years. Crime victims and their families suffer, and so does society, when offenders can escape punishment simply by crossing an international border. To combat this situation, I have set up an Article 4 Prosecutions Unit to give Texas law enforcement agencies a more effective means to pursue these criminals. The name of the unit is derived from an article of the Mexican Federal Penal Code. The reference is to a section that permits, with certain limitations, Mexican prosecution and punishment of nationals who commit crimes in foreign countries. This law has been instrumental in bringing some very serious offenders to justice in the last few years.

ARTICLE II. JUDICIAL NOTICE
RULE 201. JUDICIAL NOTICE OF ADJUDICATIVE FACTS
(a) Scope of Rule . This rule governs only judicial notice of adjudicative facts. (b) Kinds of Facts . A judicially noticed fact must be one not subject to reasonable dispute in that it is either
    (1) generally known within the territorial jurisdiction of the trial court or
    (2) capable of accurate and ready determination by resort to sources whose accuracy cannot reasonably be questioned.
(c) When Discretionary . A court may take judicial notice, whether requested or not. (d) When Mandatory . A court shall take judicial notice if requested by a party and supplied with the necessary information. (e) Opportunity to be Heard . A party is entitled upon timely request to an opportunity to be heard as to the propriety of taking judicial notice and the tenor of the matter noticed. In the absence of prior notification, the request may be made after judicial notice has been taken. (f) Time of Taking Notice . Judicial notice may be taken at any stage of the proceeding. (g) Instructing Jury . The court shall instruct the jury that it may, but is not required to, accept as conclusive any fact judicially noticed.

Summary: This section of the Texas Business & Commerce Code applies "only to a contract made solely over the Internet between a person located in this state and a person located outside this state who does not maintain an office or agent in this state for doing business in this state." It states that a contract governed by this section is governed by the law of Texas, unless each party to the contract who is located in Texas: "(1) is given notice that the law of the state in which another party to the contract is located applies to the contract; and (2) agrees to the application of that state's law." Any person asserting that the law of another state applies bears the burden of proving that notice was given and agreement was obtained as stated above.

HomeSchooling TEXAS has been saying it for years. It's nice to know that those in government know it, too. It is way past time for all other individuals and organizations giving out 'legal' information to Texas homeschoolers to get their facts straight. Misinformation about this has been circulating in home education circles for many years, thanks to certain individuals who benefit by promoting that misinformation.
Let's get it straight: "Texas has no laws or regulations related to home schooling." That includes the Leeper court decision (see below) for those of you who have been believing or telling others that parents must teach certain 'subjects' to their children in their privately funded homes. In fact, your home is not a 'private school' and claiming that it is offers you no protection from state interference and may offer you the exact opposite.
Confused because the homeschooling 'leaders' and 'experts' have informed you differently? Don't feel bad you are certainly not alone. Please continue reading this page and related links and consider for yourself. You are the parent.

Jobe, General Counsel By letter dated March 10, 1995, you requested our interpretation of Article 342-705, Texas Banking Code [ now Finance Code §59.006 ]; specifically, its application to criminal subpoenas. As we discussed by telephone several weeks ago, [ Finance Code §59.006 ] has no application to criminal subpoenas and the bank may not recover its costs from the district attorney under the authority of any laws administered by the Texas Department of Banking. You contend that [ Finance Code §59.006 ] clearly states that the article applies to civil law matters and not to criminal investigations, and for that reason cannot be construed as authority for a county to receive documents pertaining to a criminal matter or investigation without incurring costs. The criminal subpoena is not issued under this article and is therefore not subject to either its protections for customer records or its provisions for recovery of costs.     Lawyers 'Likely' to Seek Supreme Court Review By Ann Rostow On Wednesday, April 18, as last week's Texas Triangle went to press, the Texas Court of Criminal Appeals posted its routine weekly announcements. There, along with all the other routine business, was the astonishing news that the Court would not hear the appeal of the sodomy case which has been working its way through the criminal courts for four years, Lawrence and Garner v. Texas If you've lived in Texas for some time, your head has probably been spinning from fighting the sodomy law. In the last 15 years, no less than four major cases have reached either the Texas Supreme Court, the U.S. Supreme Court, or in this case, the Texas Court of Criminal Appeals. We are now four for four - no losses, no wins, because no court of "final review," has ever had the decency to hear an appeal and take a stand, once and for all, on the various state and U.S. Constitutional issues the law raises. And there are many such issues. Prior to 1974, oral and anal sex was illegal for all Texans, but after the criminal code was revised that year, heterosexual couples were written out of the law, leaving gay and lesbian couples to shoulder the ban alone. In one inexplicable detail, the 1974 revision removed criminal penalties on private bestiality. As the law now stands, a gay man or woman can have legal sex with an animal, but not with his or her life partner. Not only does the Texas sodomy law trample on the right to privacy, gay advocates argue, but it violates gay couples' right to equal protection and runs counter to the state equal rights amendment that bans sex discrimination. As for the bestiality exception, that colorful detail just adds insult to legal injury.
