These changes were made in accordance with the Virginia Administrative Process Act, which permits amendments to be made in response to federal requirement without public comment. §126-42-1. General.
1.1. Scope - This legislative rule establishes the regulations for all education programs that are to improve the quality of teaching and learning in the public schools and ensure that equal education opportunities exist for all students, including, but not limited to: comparably high quality programs of study, effective instructional strategies, work-based experiences, support programs, personnel, instructional materials, supplies, equipment, technology integration, and facilities.
1.2. Authority - W. Va. Constitution, Article XII, §2; W. Va. Code §§18-1-1 and 4; 18-2-5 and 6; 18-2E-4, 5, 7, and 8; 18-5A-4; 18A-1-1; 18A-3-26; and 18A-3a-a.
1.3. Filing Date - June 7, 2002.

Background This is a proceeding initiated by the United States Department of Education ("ED"), through the Assistant Secretary for Special Education and Rehabilitative Services ("Assistant Secretary") to withhold, pursuant to 20 U.S.C. § 1416, Fiscal Year 1995 ("FY 1995") funds made available to the Virginia Department of Education ("VaDOE" or "Applicant") under Part B of the Individuals with Disabilities Education Act, 20 U.S.C. § 1400 et seq. ("IDEA" or "IDEA-B"). ED has proposed to withhold such funds because of the Applicant's failure or refusal to mandate local educational agencies' provision of special education services to students with disabilities suspended long-term or expelled for conduct unrelated to their disabilities. VaDOE has challenged the proposed withholding on several grounds. It argues that ED may not withhold FY 1995 IDEA-B funds for Virginia's conceded refusal to mandate special education services to the above students because to do so amounts to ED's imposition of a new grant condition subsequent to its conditional approval on October 29, 1992, (with conditions not herein relevant) of Virginia's 1993-1995 IDEA-B plan.     General Regulations
    Admission Application for admission to the courses and programs of the Division of Continuing Education should be made at the office of the Regional Center where the student plans to study, or at the Division's main offices in Zehmer Hall. Registration Registration should be completed prior to the first meeting of the class. This includes completing the registration/receipt form and biographical data form, and paying all tuition and fees. Registration is not complete and transcripts are withheld until all tuition and fees are paid. In special circumstances, and with permission of the center or office director, late registration may be allowed upon payment of a late registration fee. The University of Virginia Division of Continuing Education reserves the right to modify, withdraw, or make substitutions for any of the courses announced, or to change instructors. Grades Undergraduate passing grades are A+, A, A-, B+, B, B-, C+, C, C-, D+, D, D-; a grade of F awards no credit. Certain courses may be taken on a CR/NC (credit/noncredit) basis; credits may be earned with a CR, but no grade points are awarded. Please note the changed format from the previous regulations revised in 1993. In 1992, the General Assembly authorized the codification and publication of an Administrative Code for Virginia that includes regulations of each of the state agencies. The new regulations of the Board of Education conform to that Administrative Code format. As the Board promulgates new regulations or amends regulations, the department will provide you with inserts or replacements so that you can maintain a current version of the Board's regulations.     Honor System The Honor System is one of the University's oldest and most venerated traditions. Based on the fundamental assumption that anyone who enrolls at the University subscribes to a code of ethics forbidding lying, cheating, and stealing, the Honor System allows students the kind of personal freedom possible only in an environment where respect and trust are assumed. For more than 150 years students have administered this system at the University. Although the Honor System applies to students enrolled in courses and programs through Continuing Education at off-Grounds locations as it does to students on Grounds, some procedures for administration of the system to Continuing Education students differ from those governing regular full-time students. Students may consult with the Continuing Education regional center or program office director in their area for a copy of the Honor Committee bylaws.     2003 Virginia Freshwater Fishing Regulations Fishing Education Program
    There are so many youngsters that never get to feel the tug of a fish on the line; there are adults who have forgotten the pleasures of an activity hung up years ago; there is a populace who needs to experience the simple pleasures and the connectedness that can abound from leisure time spent fishing. The Virginia Fishing Education Program was started to foster fishing in Virginia. To do so, partnerships are developed with individuals, schools, organizations, and businesses that want to help get people outside and into fishing. We provide some of the most important things that are needed to plan and conduct fishing education programs at the grass routes level. The Fishing Education staff offers training workshops to help educators obtain the skills needed to plan and implement fishing clinics, courses, clubs, and camps. They offer a variety of curriculums and activities guides that help pave the way to successful and easily implemented programs. Additional support is furnished through the provision of student materials, a tackle loaner program, and an instructor list serve. Many educators come from service organizations, conservation clubs, 4-H, Scouts, Girls/Boys Clubs, camps, nature centers, parks and recreation agencies, private businesses, and schools. Others are simply individuals with a desire to make a difference in the lives of others in their community through fishing. They often find themselves organizing fishing clubs, fishing courses, or fishing clinics under the direction of their local extension office, parks program, community college, or local school system.

    License Requirements
    All persons, except those listed below, must purchase the proper licenses before hunting or trapping.
    Everyone, including those listed below, choosing to take more than the license year limit (see deer bag limit on page 45) must purchase and use bonus deer permits or use special permits (DCAP and DMAP) which are valid only on private land and authorized public land.
    Resident or non-resident landowners, their husband or wife, children, minor grandchildren (under the age of 18), and their parents do not need a license to hunt, trap, or fish within the boundaries of their own lands and inland waters. Tenants, on the land they rent and occupy, are not required to have a license, but must have the written permission of the landowner. Residents, 65 years of age and over, do not need a license to hunt or trap on private property in their county of residence.
