High Court Decision Reflects True Spirit of the Constitution
by Marie Gryphon Marie Gryphon is an education analyst in the Center for Educational Freedom at the Cato Institute in Washington. The U.S. Supreme Court has resolved the pitched constitutional battle over Cleveland's school choice program, having kept parents and school reform advocates waiting until the last day of its annual session. Supporters of choice were rewarded for their patience with the best decision they could have hoped for. Upholding Cleveland's program, the court clarified the law to make "true private choice" the touchstone of constitutionality. This decision is not merely a victory for school reform. It is also an important win for America's tradition of educational freedom. School choice opponents argued in Zelman vs. Simmons that the Cleveland program - which offered low-income students scholarships to attend alternative private, charter or magnet schools - was an unconstitutional "establishment of religion" because many participating parents elected to send their children to parochial schools. The Supreme Court rejected that argument in a strongly worded 5-4 decision that will permanently alter the intellectual landscape of the education reform debate. Looking carefully at a quarter century of its own church-state case law, the court found a clear boundary line between two types of cases. On one hand were cases where aid recipients, such as Cleveland's scholarship families, were allowed to make "genuine and independent choices" about where to spend the aid. On the other hand were the "direct aid" cases, where money passed directly from government coffers into religious institutions.

Accreditation is important as a way of validating a given school, or department within a school; it proves the organisation has been thoroughly investigated by a group of impartial experts and found worthy of approval. Accrediting agencies will investigate the mission statement of the organisation, require proof that the school is living up to its mission goals, met its academic standards, and also look into the financial standing of the academic institution. In most other nations, colleges and universities are chartered by their national or provincial governments. Eg., the UK the Open and Distance Learning Quality Council assesses distance learning programs. But the bad news is that investigating accreditation of US schools can be really confusing, like opening a can of worms. There are many different accrediting agencies. Also beware that many "unaccredited" US schools call themselves accredited in their prospectuses and websites.. You really need to understand what the recognised accrediting agencies are. For example, the Department of Education does not accredit any school or institution, it merely "licenses" it or approves it as fulfilling certain legal requirements in order to exist at all, ranging from incorporation to certification or other state approval. Many schools which call themselves accredited private schools are in fact "licensed" schools.

  • Budget Resolution. The differences between the House and Senate Budget Resolutions for 2003 are now being worked out by a Conference Committee. The Senate Resolution includes a $2.5 billion increase for “No Child Left Behind” as compared to a cut of nearly $100 million in the House budget. The Senate bill allows for full funding of IDEA to be phased in over the next six years. Hearings on Reauthorization of IDEA Begin. On March 21, Senator Kennedy’s Health, Education, Labor and Pensions (HELP) Committee held a hearing on IDEA entitled “IDEA: What’s Good for Kids? What Works for Schools?” Safe Schools Environment Act (SEPA). While Congress went on its spring recess, staffers worked to reconcile the differences between the House and Senate versions of the Farm Bill which includes the SEPA legislation. SEPA addresses the use of pesticides in schools, and notification of families about its use. A vote of the Conference Committee is expected this week. Reauthorization of Office of Educational Research and Improvement (OERI).

A Horse Called NCLB by Anne C. Lewis WHEN the horse dies, many school reformers advise riders to dismount. Don't buy a new whip, don't form a committee to study the horse, and don't blame horses. In other words, when things are not working, change them. The same advice should be given to those who are riding a crazy horse that is galloping at full speed toward a cliff. Get off and find a mount that will get you where you want to go presumably not the bottom of a precipice, with you in a mangled heap. The trouble is that one particularly crazy horse test-based accountability under the No Child Left Behind (NCLB) Act is being ridden by advocates for poor children and guardians of "rigorous standards" for all as if it were a Kentucky Derby winner instead of a maniac steed bent on self-destruction. Let's be brutally honest. The early evidence of the impact of NCLB's test-based accountability on the states indicates that it is undermining many good policies, fostering some bad ones, and creating resentments that will not ease until better policies are developed and put in place. The growing criticism of the policies does not mean that people reject the goals of the legislation or the goals of accountability per se. Rather, the criticism stems from a realization that current standardized, high-stakes testing narrows the whole enterprise of education and could halt the development of truly significant improvements in teaching and learning.
