Overview
The state, in partnership with Bell Atlantic, recently invested $1.5 million to upgrade the state capitol's communications infrastructure to fiber optic facilities. In spring 1995 the Information Services Advisory Council began developing a statewide strategic plan for management information systems. The Division of Information Services and Communication is responsible for establishing, developing, and improving data processing and telecommunications functions in state agencies. Eight videoconferencing sites were slated to be in operation by fall 1995.

The West Virginia Rehabilitation Research and Training Center maintains Project Enable and the Job Accommodation Network, a collection of websites about its services. The Project Enable computer bulletin board and the Job Accommodation Network distribute information on disability, rehabilitation, employment, and education. The systems receive more than 4,000 calls a month seeking access to special interest discussion groups, files, and searchable databases. The Rehabilitation Research and Training Center also oversees the Rehabilitation Information System

Education Education Something is Wrong! A Vital Issue Only 14% of West Virginia 8th students are proficient in math. Something is Wrong! Government schools are supposed to provide a free, through and effcient education for our children. They do not.. Each year public schools graduate more and more students who are unable to read, write, or do basic arithmetic. Something is wrong. Our children's talents are wasted because we continue to trust politicians to do this important job. Education Week magazine's survey of quality in education states that 73% of West Virginia eight grade students cannot read proficiently and 86% cannot do math proficiently. See: Education Week. Something is wrong. West Virginian pay almost $7000 per year for each student in the government education system. We rank seventh among the states in our financial support for schools. We pay more and get less. Something is wrong.

McDowell County Marsha Timpson marshatimpson@hotmail.com The state seized control of the McDowell County school system in November 2001, after inspectors with the WV Department of Education Office of Education Performance Audit found violations of education laws and regulations in the school system. After taking control, State Superintendent of Schools Dr. David Stewart appointed Dr. Mark Manchin to the position of county superintendent. Manchin is the son of former State Treasurer and Secretary of State A. James Manchin. Within a short period of time following the seizure, the new administration revised the county's Comprehensive Educational Facilities Plan to include the closure of Northfork and Welch Middle Schools. Administrators have further ordered the closure of Panther Elementary School and indicated their intent to consolidate Big Creek and Iaegar high schools. All of these decisions have been made without holding public hearings and without a vote of the elected McDowell County Board of Education. On August 16, 2002, WV Univeristy Professor of Law Robert Bastress filed the lawsuit on behalf of several McDowell County citizens and organizations. The lawsuit asserts that state officials have improperly closed some of the schools and plan to improperly close others.

Population for 2002: Season forecast: West Virginia hunters should have an excellent season in 2002 according to Dr. Jim Crum, a state deer biologist with the West Virginia Department of Natural Resources. A lower than desired antlerless harvest last fall will lead to an abundance of deer in 2002 according to Crum. In addition, frosts in May and adverse environmental conditions (floods, droughts, etc.) may influence the mast conditions this autumn. Mast crop failures or shortages typically concentrate deer around food sources, making it easier for hunters to locate them.

    West Virginia Board of Education v. Barnette (1943) There are two clauses regarding religion in the First Amendment. One is the Establishment Clause, which prohibits the government from establishing any sort of official religion (see next document); the other is the Free Exercise Clause, which forbids the government from restricting an individual's religious practices. Free exercise claims often overlap claims to freedom of expression, and several of the most important religion cases mixed issues of free speech and free exercise together. A key element in religion clause jurisprudence is the dichotomy between belief and action originally enunciated by Chief Justice Morrison Waite in 1879. While the First Amendment absolutely prohibits government efforts to restrict beliefs, it does not prevent the state from forbidding practices that threaten public order or safety. In the example Waite used, if a sect believed in human sacrifice, the government could do nothing to restrict that belief; but it could, without violating the Free Exercise Clause, bar the actual sacrifice. While this belief/action analysis remains useful even today, the Court came to recognize that in some areas belief and action overlapped. The Jehovah's Witnesses are a relatively small sect in the United States, but they are responsible for some of the most important cases establishing religious freedom.     Is the right to free speech respected at WVU? There's good news and bad news. The good news is that the WVU speech codesregulations which threaten to punish students and faculty for expressing controversial viewpointsmay have been removed. The bad news is that they existed in the first place, and were formed with little student or faculty knowledge. Speech codes at WVU? What am I talking about? Read on. The sad story is told below.
    HISTORY OF THE CONTROVERSY
    WVAS sent the administration a letter detailing the problems with speech codes, and asked for their removal. At first, the administration refused to address our concerns. We asked the American Civil Liberties Union (ACLU) of West Virginia for helpits President, Robert Bastress, is Professor of Law at WVUand after a series of letters from WVAS and the ACLU, the administration removed the OSJ web sites.     Return Receipt Requested P 451 149 249 PRCN: 199830316138 Dear Dr. Haden: On April 20 - 24, 1998, Mr. James Walsh and Mr. James Moore, Institutional Review Specialists, conducted a program review focusing on West Virginia Wesleyan College's (the College) compliance with The Crime Awareness and Campus Security Act of 1990 (the Act). The findings of the review are presented in the enclosed report. Our review disclosed several areas where the College needs to improve its compliance with the requirements of the Act. In addition to specific findings of non-compliance, this report contains several recommendations that should enhance the quality of security information that is disseminated to the College's community. These are described in detail in the enclosed report. Specific findings of noncompliance are referenced to the applicable Federal laws and regulations. The corrective actions that are required are designed to assist the College and the higher education community in general to better understand the Act's requirements and come into compliance with the law and regulations.
