of Y2K-related lawsuits
By Eric Peterson Business Report Correspondent Almost everyone has cobbled together a vision of Y2K from the constant media barrage, with predictions ranging from a seamless transition between millennia to the catastrophe of a no-holds-barred technological meltdown. From a legal standpoint, the marrow of the issue has been liability, as in who will be held liable for Y2K software failures, and under what conditions they will be accountable. Prompted by the twin rewards of easing fear and encouraging corporate honesty, the state Legislature recently passed HB 1295, known as the Y2K Liability Act of 1999. Gov. Bill Owens signed the bill into law on April 5. The legislation was supported by "a broad spectrum" of lobbies, including the Denver Chamber of Commerce and the Colorado Association of Commerce and Industry, said Don Childears, president of the Colorado Bank Association and a member of the Governor's Y2K Task Force. "We're very pleased with it (HB 1295)," he added. "We perceive it as the strongest state law of its kind." Childears specifically highlighted three points that the legislation addresses:

    Bank Imposters Can Prey on Your Clients
    Lindsay T. Thompson , a Seattle solo practitioner (and member of the Washington State Bar Board of Governors) forwards a recent Y2K advisory from The Commerce Bank of Washington , reminding customers that Y2K may generate more than just computer glitches. "Concerns about possible Year 2000 computer problems present opportunities to defraud customers of banks, thrifts and credit unions," cautions the bank. The advisory suggests it's a good idea to warn your clients to be on the lookout for individuals posing as representatives of credit card issuers, who call cardholders requesting confidential information such as account numbers. For example, some scam artists tell customers that their cards won't work after 1/01/00 unless they attach a new magnetic strip to their cards. Other cons: individuals who call customers and ask them to transfer money from existing accounts to "special Year 2000 safe accounts." Key Web sites:

    President Clinton signed H.R. 3116, the "Examination Parity and Year 2000 Readiness for Financial Institutions Act," into law on March 20, 1998. The law gives NCUA the power to supervise credit union organizations and service providers which provide Year 2000-sensitive services. This authority expires on December 31, 2001.
    H.R. 3116 was approved by the House Banking Committee February 5 and passed the full House February 24. The Senate adopted the measure March 6, clearing it for the President's signature.

An interview with Paloma O'Riley The Millennium computer storm on the horizon will not just affect utilities, transportation, the economy, communications and the government - it will have huge impacts on legal liability and the legal system, say a growing number of legal analysts. The problem, which stems from the inability of some key computers and microchips to read four digits - is estimated to actually cost more in legal fees than to fix the problem itself. At the heart of the matter: can companies be held responsible for the actions or inactions of their products or services, due to Y2K problems? "The Y2K problem is pervasive and is anticipated to spawn court-clogging litigation in all sectors of commerce," reads a statement from a briefing session put on by the Boulder law firm of Chrisman, Bynum & Johnson. That may actually be an understatement. As of this moment, $1 trillion is expected to be spent in the U.S. on legal bills and much more worldwide. The estimate continually rises. Already, at least 25-30 lawsuits have been filed nationwide (none in Boulder county) over Y2K liability issues, and that number is expected to dramatically increase in 1999. Thousands of Y2K problems have already occurred - from minor to major - and many more will take place before 2000, as non-compliant computers hit trigger dates, such as fiscal year projections and other look-ahead functions.

Wouldn't you know the lawyers would make something out of this; hey, "Same shit, different millennium." Kronos is a Massachusetts corporation, and Massachusetts has tons of lawyers, sort of like New Jersey has toxic waste. Why did New Jersey get the toxic waste, and we got the lawyers? 'Cause they got to pick first. I caught a nasty virus from Alyce Moore in our legal department. It was a computer virus, of course, one of those "Melissa" Word macro things. You know, these days, when you get a message from someone, it's like getting a message from everyone they've ever gotten a message from. I told her she's got to start practicing "safe text". But of course, we appreciate lawyers when they're on our side, and I've gotten a great deal of help on Y2K from our Kronos attorneys, John DeLuca and Alyce Moore, and particularly Sally Wallace, who's taught me the art of thinking twice before saying nothing. The concern is multiplied times over when one adds up what the sum total effect of these EO’s and PDD’s. First of all, Executive Order 13107 decrees that human rights descend not from God but from worldly governmental authorities - with the ultimate authority represented by the United Nations. From all we see, it seems that the UN believes people have the right to dissent, unless it is dissent against the United Nations. Now with that as the basis of his logic, consider that all things terrifying, socialistic and unconstitutional are possible, at least in the mind of globalist Bill Clinton.

    Stephen Brock is senior litigation associate with the law firm of Christie, Pabarue, Mortensen and Young in Philadelphia. Brock has been doing a lot of thinking about the issue of e-mail confidentiality as it relates to internal discussions on the Year 2000 problem, and we picked his brain for some warnings and legal problem-prevention techniques. "The background is really very simple," Brock says. "Every company must address the Y2K situation and, in doing that, they don't want to create another problem or potential liability for the company. The Y2K problem is unique because everyone knows it's coming and there is debate about the extent of the potential liability. Some figures go into the trillions of dollars. While no one can really know what the true cost of fixing the computer systems will be, it's projected that the legal issues, the product and corporate liability litigation, will be an even larger potential expense. "Put those two things together and you can see that we have a double whammy. With the liability of Y2K and the casual nature of e-mail, companies can face serious threats to their viability. Executives must take steps to be sure their employees at all levels treat e-mail correctly and keep them confidential."

    Law firm aims to clear up Y2K confusion
    Still confused about the so-called "Millennium Bug?" A law firm is offering Y2K seminars from a legal standpoint at three sites around Pennsylvania in August. The session will be repeated at 2 p.m. Aug. 7 at the offices of The Patriot-News, Harrisburg, and at 2 p.m. Aug. 14 in the auditorium of The Morning Call, Allentown. Speakers will be John Cramer, Joe Moran and Kerry Kearney. Kearney is co-chairman of the firm's 57-lawyer Y2K group. All three attorneys have done work on Y2K for a variety of clients. Topics include:
    • How the Year 2000 will affect information gathering
    • embedded technology; financial software and employment issues (like retirements and pension plans)
    • government regulations
    • legal protections against non-compliant suppliers
    • responding to compliance inquiries
    • contingency planning
    • and how newspapers can help inform the public (why isn't it a front page story?).
    The sessions are free and are being organized by PNPA's Year 2000 Task Force.

    What was John Koskinen, a federal potentate, talking about when he said, “[i]n a crisis and emergency situation, the free market may not be the best way to distribute resources?” What bee got stuck in the bonnet of Sen. Robert Bennett, Republican of Utah, when he asked the U.S. Deputy Secretary of Defense if the military was prepared to implement martial law? And why have the Canadian armed forces gone beyond speculation with Operation Abacus, a plan that will place troops in urban centers and naval vessels in ports around the country? Why, it’s all for Y2K, and if these people planned to scare the millennium bug into submission, they may have chosen the right approach. The problem, though, is that this emergency planning follows in well-trod and rather suspect footsteps. But if history is any judge, emergency measures are at least as likely to be the problem as they are to solve any problems, and even if used “properly” they’re likely to leave us all with a nasty mess to clean up. The Y2K bug isn’t the first crisis of the moment that we’ve faced, and it’s unlikely to be the last. Each situation has produced panicked calls for the government to “do something,” and the people in power have been more than happy to oblige. It’s an old cliche that “war is the health of the state” and it’s probably more accurate to say that politicians thrive on anything that scares the bejeesus out of people.     Jan. 1, 1999 The Information Technology Association of America will be conducting a special Webcast program consisting of two parts - audio and visual - on Wednesday, January 13, 1999 from 3:00-5:00 p.m. (EST) on the Year 2000 Information and Readiness Disclosure law. In order to participate in this program, participants must register in advance (by cob on Monday, January 11, 1999) and have Internet access. The cost to participate will only be the cost of a long distance phone call. A number of questions have come up regarding the law's applicability, protections, and the procedures a company should follow in order to make full use of its provisions. Leading legal/policy experts, who have helped draft the bill over the past year, will present an overview of the law and touch on some of the issues that have been raised by the SEC Y2K rules.
